Esta instancia fue posible luego de la anulación de las leyes de Punto Final (1986) y Obediencia Debida (1987) en el año 2003, y su posterior declaración de inconstitucionalidad por parte de la Corte Suprema de la Nación en el año 2005. Los juicios han tomado gran relevancia tanto a nivel nacional como internacional ya que configuran un caso excepcional en el cual se juzga a los responsables de los crímenes cometidos por el estado en el contexto jurídico nacional, con jueces naturales –no especiales-, en el fuero penal federal, sin la intervención de tribunales ni organismos internacionales. Es decir, es el propio estado el que juzga a los crímenes que otrora cometió. Esta tesis analiza los modos en que los diarios Clarín, La Nación y Página 12 caracterizaron los juicios contra los responsables del genocidio perpetrado en Argentina durante la última dictadura militar en la provincia de Buenos Aires en el período comprendido entre los años 2006 y 2015. La caracterización de los juicios se centra en el análisis de tres figuras que emergieron del trabajo de archivo: los delitos juzgados, las víctimas y los imputados. Para la realización de la investigación se optó por la perspectiva lingüística desarrollada por Felipe Maillo Salgado centrada en el análisis de los estereotipos en tanto construcciones discursivas que a partir de sus sentidos asociados configuran determinadas cosmovisiones. A esta perspectiva se articuló el método arqueológico foucaultiano como herramienta heurística para abordar el corpus documental en tanto archivo, como la ley de lo decible, lo que marca las posibilidades de la enunciación y que no necesariamente se vincula a la coherencia de lo enunciado. Estas elecciones teóricas posibilitaron la emergencia de las figuras de los delitos, las víctimas y los imputados, así también como la de sus estereotipos a partir de los modos mayoritarios de caracterizar a cada una de ellas. Se trabajó sobre un corpus documental constituido por la totalidad de las publicaciones periodísticas vinculadas a la cobertura de los cuarenta juicios que se desarrollaron en Buenos Aires durante el período 2006-2015. De la totalidad se eligieron intencionalmente once casos y del análisis de dicho segundo corpus de publicaciones emergieron las tres figuras analíticas fundamentales de la tesis: los delitos, las víctimas y los imputados. La presente tesis propone que los juicios que se desarrollan desde el año 2006 contra los responsables de los crímenes cometidos durante la última dictadura militar constituyen un espacio fundamental a la hora de explicar lo sucedido durante la experiencia genocida, de narrarla y otorgarle sentidos contribuyendo a los modos en que la sociedad elabora sus consecuencias. En esta línea, se sostiene que el discurso que se construye en el escenario judicial como así también la verdad construida jurídicamente en las sentencias adquiere un valor específico de mayor categoría simbólica respecto a otros discursos por ser una verdad construida y sostenida por uno de los poderes del estado y por constituir el espacio en el que se señalan responsabilidades éstas son reconocidas colectivamente. La hipótesis fundamental de la tesis se monta sobre el supuesto anterior: el discurso jurídico tiene un peso específico respecto a otros discursos en tanto verdad estatal socialmente aceptada con la capacidad de performar otros discursos sociales una vez que el mismo ha sido pronunciado, generando efectos respecto a los modos de nombrar a los hechos juzgados y a sus actores intervinientes. Por último, esta tesis incorpora una variable de análisis surgida del trabajo de archivo fundada en una tensión constitutiva entre las caracterizaciones de los delitos como lesa humanidad y genocidio. Esta tensión se encuentra presente desde el inicio del trabajo, recorre a cada una de las figuras analíticas y se expresa a partir de dos modalidades de explicación: una que remite a hechos y sujetos individuales y otra que remite a planificación y sistematicidad. In 2006, a large-scale criminal process was launched in Argentina against the responsible and perpetrators of the systematic human rights violations committed by the state during the last military dictatorship (1976-1983). This instance was possible after the annulment of the laws of "Punto Final" (1986) and "Obediencia Debida" (1987) in 2003, and its subsequent declaration of unconstitutionality by the Supreme Court of the Nation in 2005. The trials have taken great relevance both nationally and internationally as they make up an exceptional case in which those responsible for crimes committed by the state are judged in the national legal context, by natural judges - not special - in the criminal law jurisdiction, without the intervention of international courts. Therefore, it is the state itself that judges the crimes it once committed. This thesis analyzes the ways in which the newspapers Clarín, La Nación and Página 12 characterized the trials against those responsible for the genocide perpetrated in Argentina during the last military dictatorship, in the province of Buenos Aires in the period between 2006 and 2015. The characterization of the trials focuses on the analysis of three figures that emerged from the archive work: the crimes tried, the victims and the accused. The linguistic perspective developed by Felipe Maillo Salgado was chosen in order to carry out the research. This perspective focuses on the analysis of stereotypes as discursive constructions that, based on their associated senses, configure certain worldviews. To this perspective, the foucaultian archaeological method was articulated as a heuristic tool to approach the documentary corpus as a file, as the law which marks the possibilities of the enunciation and that is not necessarily linked to the coherence of the enunciated. These theoretical choices allowed the emergence of the figures of the crimes, the victims and the accused, as well as that of their stereotypes that emerged from the major modes of characterizing each of one of these figures. The investigation was carried out by a documentary corpus constituted by all the journalistic publications related to the coverage of the forty trials that took place in Buenos Aires during the period 2006-2015. Eleven cases were intentionally chosen and from the analysis of the second corpus of publications emerged the three fundamental analytical figures of the thesis: the crimes, the victims and the accused. This thesis proposes that the trials that have taken place since 2006 against those responsible for the crimes committed during the last military dictatorship constitute a fundamental space to explain what happened during the genocidal experience and to narrate it, contributing to the ways in which society elaborate its consequences. In this sense, this thesis holds that the discourse that is constructed in the judicial scenario as well as the truth built legally in the veredicts, acquires a specific value of greater symbolic category with respect to other discourses. This is because it is a truth built and sustained by one of the powers of the state and because it constitutes the space in which responsibilities are pointed out and are collectively recognized. The fundamental hypothesis of the thesis is based on the previous assumption: legal discourse has a specific weight with respect to other discourses for being a socially accepted state truth with the capacity to perform other social discourses once it has been pronounced, generating effects on to the ways of naming the facts judged and their intervening actors. Finally, this thesis incorporates a variable of analysis arising from archival work based on a constitutive tension between the characterizations of crimes against humanity and genocide. This tension is present from the beginning of the research, runs through each of the analytical figures and is expressed from two modes of explanation: one that refers to facts and individual subjects and another that refers to planning and systematicity.
