El objetivo general de esta tesis es realizar un análisis del proceso de acceso a la justicia de las trabajadoras de casas particulares migrantes internacionales. Parte fundamental de este estudio pretende cuestionar el concepto de acceso a la justicia comprendido como un derecho humano, que debe ser estudiado teniendo en cuenta las dimensiones redistributiva, representativa y de reconocimiento de todos los sujetos que hacen parte de determinada comunidad política (Fraser, 2009). Los principales resultados de esta tesis dan cuenta de que existen distintos andamiajes culturales e institucionales a desmontar cuando se inicia un proceso de transición legislativa. Y para ello se analiza el impacto de las derogadas y actuales normas de migraciones y de trabajo en casas particulares, en el acceso a la justicia de las trabajadoras migrantes. Además, para entender la transición legislativa se analizaron los debates parlamentarios de la ley 26844 de trabajo en casas particulares, que dieron cuenta de las tensiones paradigmáticas en la configuración de un nuevo derecho que intenta proteger, con timidez, los derechos de las trabajadoras domésticas. Las nuevas normas trajeron cambios en las trabajadoras domésticas migrantes en cuanto a su capacidad de agencia, a partir que se configuraron distintos circuitos de información, que utilizaron para conocer sus derechos e informarse de los lugares donde deben acudir para reclamarlos. Estos circuitos exponen las formas en que las mujeres resisten y tramitan los recursos para acceder a la justicia, sobrepasando las situaciones de aislamiento, los prejuicios en su contra por parte de las instituciones y las relaciones de poder/saber/afecto con quienes las emplean. Por último, se analizaron las formas en que estás trabajadoras migrantes recorren la ""ventanilla de la justicia"", analizando sus posibilidades y límites para permanecer en un juicio, los recursos disponibles del Estado, los remedios jurídicos invocados ante situaciones de pobreza extrema y finalmente especificando su paso por el Tribunal de Trabajo para el Personal de Casas Particulares. Allí se exponen las historias de juicios fallidos, otros con ganancia parcial y otros exitosos. Evidenciando los distintos trayectos que las trabajadoras migrantes pueden vivenciar ante la justicia. Para esta tesis se implementó una metodología mixta donde se realizó: a) un análisis documental de textos, normas, decretos y debates parlamentarios, b) entrevistas a profundidad a trabajadoras domésticas migrantes, funcionarios del Tribunal de Trabajo para el Personal de Casas Particulares y, c) la investigación militante que más allá de ayudarme a relacionar las distintas técnicas me posicionó en el campo al servicio de las investigadas, en el contexto de grupos diagnóstico-informativos donde se realizaron capacitaciones sobre los derechos de las trabajadoras migrantes.^^Fil: Jaramillo Fonnegra, Verónica. The overall objective of this thesis is to study the process of access to justice by international migrants working in private households. A fundamental part of this analysis is to question the concept of access to justice, understood as a human right that must be analyzed in its recognition, redistributive, representation and dimensions of all the people who form part of a particular political community (Fraser, 2009). The main findings of this thesis reveal that there are different systems cultural and institutional to be dismantled when a process of legislative transition begins. To this end, the impact of the abrogated and current law on migration and domestics work, on access to justice for migrant workers. In addition, in order to understand the legislative transition, the parliamentary debates of law 26844 on domestic work were analyzed, which showed the paradigmatic tensions involved in configuring a new right that tries to protect, albeit timidly, the rights of domestic workers. The new laws brought changes for migrant domestic workers in terms of their capacity for agency, since different information circuits were configured that they used to learn about their rights and find out where to go to demand respect for them. These circuits expose the ways in which women resist and process the resources for accessing justice, overcoming situations of isolation, prejudices that they have regarding the institutional prejudices that they face and the relations of power / knowledge / affection with their employers. Finally, this thesis analyzes the ways in which these migrant workers interact with the judicial system, analyzing their possibilities and limits to persist with a trial, available state resources, the legal remedies invoked in situations of extreme poverty and finally specifying their passage through the Labor Court for Private Household Personnel. There the stories of failed trials, some with partial gains and other successful ones are laid bare demonstrating the different experiences that migrant workers may have with the judiciary. For this thesis, a mixed methodology was implemented that included: a) a documentary analysis of texts, laws, decrees and parliamentary debates; b) in-depth interviews with migrant domestic workers and officials of the Labor Court for Private Household Personnel; and c) activist research that, besides helping me to link the different techniques, positioned me in the field at the service of the researched women, in the context of diagnostic-informative groups where training was given on the rights of female migrant workers.";"INTRODUCCIÓN 1.
