Argentina Temporal Coverage Temporal characteristics of the resource. 1989-1999 Description An account of the resource El objetivo del trabajo fue explicar cómo se formuló e implementó la política de reforma laboral y de obras sociales durante los gobiernos de Carlos Menem, analizando centralmente el modo en que la relación establecida entre el gobierno y los sindicatos condicionó la adopción de medidas, que derivaron en determinados resultados sobre el mercado de trabajo y las características de la cobertura de salud. Postulo que la crisis existente a principios de los años noventa no fue suficiente para comprender el conjunto de iniciativas oficiales, sino que las políticas adoptadas fueron producto de factores que tuvieron que ver con la definición del problema, los actores que pudieron influir en la discusión, las soluciones pasibles de ser escogidas y con el contexto económico y político en el que las medidas fueron discutidas. Las decisiones fueron resultado de acuerdos y presiones efectuadas por diferentes grupos (especialmente el sindicalismo), además de las oportunidades de elección que tuvieron los formuladores de políticas públicas. El hecho que ciertos sectores del sindicalismo fueran un componente importante de la coalición menemista, condicionó el tipo de políticas implementadas, pudiendo limitar así el alcance de las iniciativas oficiales, privilegiando algunos de los intereses del llamado “sindicalismo de negocios”. Asimismo, intenté demostrar cómo el retroceso en algunas iniciativas gubernamentales o el retardo para implementarlas fue una contraprestación frente a la necesidad de conseguir apoyo sindical para la puesta en práctica de otros proyectos que se consideraban prioritarios En los tres primeros capítulos desarrollo el marco teórico, los objetivos y las hipótesis planteadas, así como la metodología utilizada en el trabajo; describo brevemente la legislación laboral y la referida al desarrollo del sistema de obras sociales hasta 1.989, junto a los cambios ocurridos en el campo sindical. También analizo los principales problemas existentes en el plano laboral y el del funcionamiento de las obras sociales, enfatizando las tendencias que pudieran dar lugar a una definición de la crisis que favoreciera la adopción de determinadas políticas. Posteriormente, analizo los principales planteos al inicio de la primera presidencia de Menem, resaltando la caracterización de los problemas y la división de la central sindical, haciendo hincapié en el posicionamiento de los actores frente a los proyectos gubernamentales. Se describe cómo el manejo del sistema de obras sociales se convierte en un mecanismo de disciplinamiento de los sindicatos. En el capítulo quinto se explicitan los intentos por instrumentar reformas más profundas en materia laboral y de obras sociales. Se analiza la sanción de las leyes 24.013 y 24.028, así como el intento de trasformación de obras sociales con el proyecto de creación de la OSAM. Se caracteriza la reacción de los actores sociales frente a las iniciativas, particularmente de las organizaciones gremiales. Por otra parte, se ilustran los cambios en el mapa sindical a partir de la creación del C.T.A. Además, se desarrollarán las modificaciones en materia salarial introducidas como correlato del Plan de Convertibilidad, considerando el posicionamiento que los gremios adoptan frente a esos cambios. En el siguiente apartado se analizan las tensiones en la C.G.T. y el intento de introducir cambios en materia laboral durante la gestión como Ministro de Trabajo de Enrique Rodríguez. Se desarrolla el cambio de estrategia en relación con la desregulación del sistema de obras sociales, mediante el dictado de decretos. Se describen las propuestas formuladas por Armando Caro Figueroa, el envío de un nuevo proyecto de reforma laboral y el rechazo de la C.G.T. al mismo, que terminó con el fracaso parlamentario de la iniciativa y la renuncia de Rodríguez. En el capítulo siete se examina el período más prolífico en reformas, con la llegada de Caro Figueroa al Ministerio de Trabajo y el establecimiento de una nueva relación con la C.G.T., en la que alcanza la Secretaría General Antonio Cassia, surgiendo el M.T.A como una línea opositora dentro de la organización gremial. Se describe la respuesta favorable del gobierno a ciertas demandas sindicales y la constitución de un espacio de negociación con el “Acuerdo Marco para el empleo, la Productividad y la Equidad Social”, y el establecimiento de programas para crear empleo. Además, se explicita el proceso de negociación para la implementación de la desregulación en el sistema de obras sociales. Luego, se desarrollan los desacuerdos con la C.G.T. ante los pedidos de ésta para instrumentar medidas que frenaran los despidos y se estableciera la emergencia ocupacional. Se caracteriza el crecimiento del M.T.A. y la C.T.A. y los enfrentamientos entre gremios, así como se analiza el cambio al interior de la C.G.T., con la secretaría de Daer. Se describen los decretos laborales de fines de 1.996, la implementación de la Ley de Riesgos de Trabajo y el avance en la desregulación del sistema de obras sociales. En el noveno capítulo se explican los cambios producidos luego de la sustitución de Caro Figueroa por Erman González, con la sanción de la Ley 25.013 y se describen las características del funcionamiento de los sistemas de A. R. T. y de obras sociales, considerando la implementación de medidas que reflejan el fortalecimiento de gremios cercanos al menemismo. Finalmente, en el último capítulo formulo las conclusiones, en base a mis hipótesis, remarcando el carácter cambiante que ha tenido la relación gobierno sindicatos durante el período analizado. The objective of this paper is to explain how they are formulated and implemented the policy of labor reform and “obras sociales” system during the governments of Carlos Menem, centrally by analyzing the way in which the relationship established between the Government and trade unions conditioned action, which led to specific results on the labour market and the characteristics of health coverage. I postulate that the crisis at the beginning of the 1990s was not enough to understand the set of official initiatives, but that policies adopted had to do with the definition of the problem, the actors that could influence the discussion, solutions could be chosen and with the economic and political context in which the measures were discussed. Decisions were the result of agreements and pressures made by different groups (especially trade unionism), as well as opportunities for choice that had public policy makers. The fact that certain sectors of trade unionism was an important component of the menemist coalition conditioned the type of policies implemented, and can thus limit the scope of official initiatives, favoring some of the interests of the so-called "sindicalismo de negocios".
